Overall objectives:

1 - Basic understanding of the concept of law and the function of the legal system and the law.
2 - Domain and application of basic concepts in the context of labour law.
3 - Understanding of the methods of analysis, interpretation, integration and application of the Law and its application to practical cases.
4 - Basic understanding, in order to facilitate the understanding of legal problems, the structure and elements of the legal relationship, the obligatory relationship, the facts that generate obligations, the guarantees of obligations and the assumptions of compliance or non-compliance with obligations and legal consequences.
5 - Application of concepts to practical cases.

Syllabus:

1 - Introduction to law.
1.1 - The concept of law. Brief analysis of the Portuguese legal system. Concept of legal norm.
1.2 - Law and the State.
1.3 - Interpretation, integration and application of legal rules.
2 - The sources of law.
2.1 - Concept of normative acts. Plea. The Constitution, the Law and the Regulations. The hierarchy of normative acts. The legislative process.
3 - The legal relationship.
3.1 - Concept, elements and structure of the legal relationship.
3.2 - The identification of the subjects of the legal relationship.
3.3 - The content of the legal relationship and the legal fact. The subjective right. Legal duty, obligation and subjection.
3.4 - The question of guaranteeing the legal relationship.
4 - Mandatory legal relationships.
4.1 - The mandatory legal relationship and the elements of the mandatory relationship. Simple legal acts and legal affairs.
4.2 - Compliance and non-compliance with obligations. Civil liability. Special guarantees of obligations.
5 - Introduction to Labor Law.
5.1 - General notions: sources, contracts, workers and employer.
5.2 - Individual work relationships. Analysis of contract formation.
6 - Resolution of practical cases.

Evaluation Methodology:
The evaluation of the Course Unit includes the completion of a frequency with a weight of 50% and a work with a weight of 50%, in the final evaluation. Both elements can be recovered at the time of appeal and/or be subject to improvement.
